Terms of Service for PathXplorer

1. Acceptance of Terms

By downloading, installing, or using PathXplorer ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

PathXplorer is a GPS tracking and route recording application that allows users to:

Track and record routes and activities
View maps and navigation information
Monitor speed, distance, elevation, and other metrics
Export and share tracked routes
View weather information (optional feature)

3. User Responsibilities

When using PathXplorer, you agree to:

Use the App safely: Do not use PathXplorer in a manner that distracts you while driving, cycling, or engaging in any activity requiring your full attention.
Comply with laws: Use the App in compliance with all applicable local, state, national, and international laws and regulations.
Respect others' privacy: Do not use the App to track or monitor others without their knowledge and consent.
Maintain your device: Ensure your device has adequate battery, storage, and connectivity for proper App functionality.

4. Subscription and Payments

PathXplorer Free vs PathXplorer Fun

PathXplorer offers both free and premium subscription options:

PathXplorer Free: Basic features with some limitations on daily route usage and advanced features.
PathXplorer Fun: Premium subscription with unlimited access to all features.

Subscription payments are processed through Google Play. By subscribing, you agree to Google Play's terms and payment policies. Subscriptions automatically renew unless cancelled before the renewal date.

5. Intellectual Property

The App, including its design, features, code, and content, is owned by Charles-Emmanuel Barcelo and is protected by copyright and other intellectual property laws. You may not:

Copy, modify, or distribute the App
Reverse engineer or decompile the App
Remove any copyright or proprietary notices
Use the App's name or branding without permission

6. Third-Party Services

PathXplorer uses third-party services including:

OpenStreetMap: For map data and tiles
Open-Meteo: For weather information
OpenRouteService: For routing calculations
Google Play Services: For billing and app distribution

Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or content provided by third-party services.

7. GPS and Location Accuracy

Important: GPS accuracy can be affected by various factors including atmospheric conditions, device hardware, obstructions, and signal interference. PathXplorer provides location data on an "as-is" basis and does not guarantee:

Absolute accuracy of GPS coordinates
Continuous GPS signal availability
Accuracy of calculated distances, speeds, or elevations

Do not rely solely on PathXplorer for critical navigation or safety purposes.

8. Disclaimer of Warranties

PathXplorer is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or reliability of any information obtained through the App

9. Limitation of Liability

To the maximum extent permitted by law, Charles-Emmanuel Barcelo and PathXplorer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data or tracked routes
Personal injury resulting from use of the App
Property damage
Loss of profits or revenue
Damages arising from reliance on GPS data

10. Indemnification

You agree to indemnify and hold harmless Charles-Emmanuel Barcelo from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend access to the App for violations of these Terms or for any other reason at our discretion.

12. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted within the App, and the "Last updated" date will be revised. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles.
